RULES FOR USING THE BITCOS PLATFORM

These rules are valid as amended on October 9, 2023

1. General provisions

These Terms of Use of the Bitcos Platform apply between the User ("you", "your" or "user") and the Bitcos project ("Bitcos", "us", "we", "our" or "project"). By clicking "I agree", "Proceed", as well as using the Bitcos project website or any of its products/services (hereinafter referred to as the products, Platform) of Bitcos or its partners within the Bitcos ecosystem, you confirm that you have carefully read and unconditionally accept all of the following terms and conditions.

Bitcos reserves the right, at its sole discretion, to change or replace any part of these Rules or any other documents, policies at any time, as well as the functionality of the Platform or products, services, services, etc. At the same time, Bitcos will make efforts to notify changes in advance, as a rule, at least 30 calendar days before this one. The User may not transfer his rights or obligations in whole or in part in accordance with these Terms of Use to any third party.
The User acknowledges and accepts the fact that Bitcos may transfer its rights and obligations in accordance with these Terms of Use, as well as provide or transfer to a third party the information provided by the User when using the Services.

2. Definitions

When mentioned in these conditions , the terms listed below are used in the following meanings:

Crypto assets are a type of digital assets that can be transferred using blockchain technology. These include both cryptocurrencies and non-interchangeable tokens (NFT).

The Bitcos wallet is a software that interacts with various blockchain networks to create and manage sets of private and public keys, initialize and sign transactions, and monitor the balance of addresses.

A 12-word recovery phrase (Seed phrase) is a unique confidential sequence of words that are generated by the Bitcos software from which words users' private keys are created. These phrases are needed to access Crypto Assets in a crypto wallet and manage them by the owner. Bitcos reserves the right to set a 24-word Recovery Phrase (Seed phrase).

Private keys are an important part of the information that makes it possible to conduct cryptocurrency transactions in the blockchain.

User – an individual, legal entity, public authority or other entity that uses the Bitcos software in accordance with these Rules.

Services, services - one or more services, Bitcos services, as well as services of third-party contractors or Bitcos partners.

Bitcos products are software created by Bitcos or its counterparties, protected by cryptographic means, combined into an eco-system, designed to perform operations with crypto assets or other operations defined by Bitcos.

The Bitcos platform is a software created by Bitcos that combines all Bitcos products into a single eco-system.

Third-party services/services - any services, applications, software or other materials that are hosted, developed and/or managed by third parties. Among other things, we are talking about the exchange of one cryptocurrency for another – i.e. in a swap, as well as staking, buying and selling cryptocurrencies, displaying the balance in fiat currency, displaying the exchange rate, DeFi-applications for lending and cryptocurrency loans, demonstrating NFT, as well as creating, buying or selling NFT and other things.

Bitcos tokens (BWT) are tokens used inside the Bitcos eco–system to make transactions, pay for services (GS), other Bitcos services or perform other operations allowed in the eco-system.

Website - websites and pages that belong to Bitcos and are managed by this project and hosted on Bitcos domains.

Bitcos Promotions are events held in order to increase User activity, promote and attract attention to the Bitcos Platform, which is not a public offer.

3. Risk warnings and recommendations

3.1. You confirm that you are fully aware of all applicable laws and technical restrictions that are associated with the Bitcos platform, as well as with blockchains based on Proof of Work (PoW) and Proof of Ownership (PoS) consensus mechanisms. You also confirm that you have been warned about the following risks associated with this activity and have received the following recommendations:

3.1.1. Blockchain technologies and related services are subject to constant regulatory changes and controls around the world, including, among other things, anti-money laundering measures, financial regulation, etc. You understand and acknowledge that, depending on the jurisdiction, there may be one or more regulatory requirements that may affect the Bitcos Platform and its availability of use.

3.1.2. Storage, possession, execution of transactions or operations with crypto assets, exchange, participation in airdrops, forks, income from staking, etc. - may be subject to taxation in accordance with the legislation of the country in which you reside. For this reason, you definitely need to consult with a tax or accounting consultant, lawyers, before carrying out any actions with crypto assets.

3.1.3. Hackers or other groups and associations of attackers may try to interfere with the operation of the Bitcos Platform in various ways, including, but not limited to, denial of service attacks, side channel attacks, spoofing, smurfing, malware attacks, consensus-based attacks, and so on..

3.1.4. The User is aware that some technologies within the framework of the Bitcos Platform provided are new, untested or not owned by Bitcos, and therefore not controlled by Bitcos. At the same time, advances in cryptography or other technical improvements such as the development of quantum computers may pose risks to blockchain networks, and may also lead to theft or loss of crypto assets. At the same time, the development of technologies may worsen or jeopardize the efficiency of Bitcos in accordance with these Rules.

3.1.5. All transactions initiated using the Bitcos Platform are confirmed and recorded in blockchain networks. These networks are decentralized and peer-to-peer. They are managed by independent third-party operators that Bitcos does not own, manage or dispose of. Bitcos does not control what is happening in blockchain networks and therefore cannot guarantee (and does not guarantee) the prospects for processing and confirming transactions initiated by the User using the Bitcos Platform. The User hereby acknowledges that Bitcos does not store, send or receive Crypto Assets on behalf of the User. The user also agrees that the transactions that he conducts using the Bitcos Platform are irreversible, may not pass or may be carried out much later due to the peculiarities of blockchain networks. Sometimes the main blockchain protocol of a certain crypto asset may change, which may affect its key characteristics, including, among other things, accessibility, name, security system, value, principles of operation, and so on. It can also happen due to a fork, which causes crypto assets to be incorrectly redirected or reproduced.. In this and other cases, Bitcos may, at its discretion, decide to suspend support for a certain crypto asset until it deems it necessary or refuse to support it. If such a decision is made, Bitcos will try to notify the User about it in advance, however, there is a possibility that the company will not be able to do this. You should be aware of what is happening and, if necessary, take all necessary measures. The Bitcos liquidity pool can be formed with the participation of centralized or decentralized crypto exchanges. In case of any problems with these exchanges, such as, for example, non-execution of orders, delay in execution of orders, liquidation, bankruptcy, hacking or other similar negative events, Bitcos is not responsible for their actions and their condition.

3.1.6. The user must take all necessary measures to ensure that his account data is kept safe. When you first set up the Bitcos crypto wallet or use another Bitcos product, you will be required to:

1) keep your Recovery Phrase (Seed phrase) of 12 (24) words safe;

2) ensure that any persons cannot access the Recovery Phrase (Seed phrase), their Bitcos crypto wallet or other Bitcos product. The User is solely responsible for the proper use of the Bitcos Platform, as well as for taking other appropriate measures to ensure the security, protection and backup of accounts and/or content in such a way as to ensure appropriate security and protection. If you cannot be responsible for the security of your account or do not want to make such a commitment, you should not use the Bitcos Platform. Your obligations include ensuring the timely installation or implementation of all available software updates or updates of the Bitcos Platform used, as well as recording and securely storing any passwords or recovery phrases associated with the use of the Bitcos Platform. The user acknowledges that some methods of protecting the secret phrase, for example, storing it as a digital file on a personal device or with a cloud storage provider, may increase the risk that his account or secret recovery phrase will be compromised.. The User also acknowledges that he will not transfer to Bitcos or any other third party any password or secret phrase for recovery related to the use of the Bitcos Platform, and that Bitcos will not be responsible if the User reports any such password or recovery phrase, regardless of whether he does it knowingly or unknowingly, including under someone's influence. For the avoidance of doubt, Bitcos assumes no responsibility for any theft or other form of loss of the recovery secret phrase or access to the Bitcos Platform by any person on behalf of the User.

3.1.7 Neither party nor its respective affiliates are responsible for any delay or failure to fulfill any obligations between the User and Bitcos if the delay or failure is caused by force majeure.

3.1.8 Force majeure circumstances must be both extraordinary and unavoidable under these conditions. Circumstances of force majeure may include: natural phenomena (earthquake, hurricane, tornado, tornado, typhoon, tsunami, storm, flood, drought, frost, landslides), mass diseases (epidemic, pandemic, epizootic), armed conflicts (military operations of any kind, military actions, war (declared or undeclared), preparations for war, revolution, insurrection, civil unrest, blockade, seizure of power, mobilization, terrorist acts), labor conflicts (strike, lockout, strike, boycott), actions of authorities, including foreign ones (prohibitive measures of states, including prohibition of exports or imports, embargo, prohibition of trade operations with by individual countries due to international sanctions; prohibition of currency transfer, prohibition of energy use; acts of state bodies or local self-government bodies). 3.1.9. These Rules are implemented in Russian. All messages and notifications made or provided in accordance with these Rules will also be executed in Russian. If Bitcos provides a translation of these Rules in English or the translation is carried out independently by the User, these Rules in Russian will take precedence in case of any contradictions.

3.1.10. The User is solely responsible for the calculation and payment of all taxes and other mandatory payments, as well as any fines and penalties that may arise. At the same time, Bitcos reserves the right to withhold tax amounts if this is established by tax legislation..

ALSO, BITCOS DOES NOT STORE PASSWORDS, RECOVERY PHRASES OF 12 (24) WORDS, OTHER PASSWORDS, TRANSACTION HISTORY, OR OTHER ACCOUNT DATA REQUIRED WHEN YOU USE THE BITCOS PLATFORM..
IN CASE OF LOSS, THEFT, OR OTHER INABILITY TO ACCESS THE RECOVERY PHRASE (SEED PHRASE) OR OTHER DATA GENERATED BY THE BITCOS SOFTWARE – THIS ENTAILS TERMINATION OF ACCESS TO THE BITCOS PLATFORM.
IN SUCH SITUATIONS, BITCOS IS NOT ABLE TO HELP RESTORE THE LISTED ACCOUNT DATA. IN THIS REGARD, THE USER IS SOLELY RESPONSIBLE FOR MEMORIZING, PRESERVING THE RECOVERY PHRASE (SEED PHRASE) AND OTHER DATA OF YOUR ACCOUNT IN A SAFE AND SECURE PLACE. ACCORDINGLY, ANY PERSON WHO HAS GAINED ACCESS TO THE RECOVERY PHRASE (SEED PHRASE) OR OTHER DATA OF THE USER CAN GAIN CONTROL OVER THE USER'S CRYPTO ASSETS AND THE ABILITY TO DISPOSE OF THEM AT THEIR DISCRETION WITHOUT ANY POSSIBILITY OF THEIR RECOVERY IN THE FUTURE ON THE PART OF THE USER OR ON THE PART OF BITCOS.
CONSIDERING THAT ACCESS TO THE BITCOS PLATFORM IS CARRIED OUT VIA THE INTERNET, BITCOS IS NOT RESPONSIBLE FOR THE RELIABILITY AND FUNCTIONING OF NODES, COMMUNICATIONS OR OTHER TECHNICAL DEVICES CONNECTING THE USER AND BITCOS AND PROVIDING ACCESS TO THE BITCOS PLATFORM.
BITCOS IS NOT RESPONSIBLE FOR CONNECTING THIRD-PARTY CRYPTOCURRENCIES, FOR MAKING TRANSACTIONS USING THEM, DIGITAL ASSETS STORED ON THEM, OR OTHER USER ACTIONS RELATED TO SUCH CRYPTOCURRENCIES.

3.2. Before making any transaction, the User must make sure at least twice that the information displayed on the screen of the device used is correct (correct). When sending Crypto Assets, the User is fully responsible for verifying the correctness of the recipient's address, the total amount of the transaction and the amount of commissions, as well as their compliance with the data he received from the recipient. The User acknowledges that the use of all addresses to receive or send Crypto Assets is at his own risk.

3.3. The user acknowledges that he has received the necessary amount of information about crypto assets, about the blockchain and the principles of its operation and is aware of the risks that exist when using crypto assets and blockchain and fully accepts them.

3.4. When using the Bitcos Platform, additional risks may arise that were not provided for or specified by us in these Rules. Therefore, before using the Bitcos Platform, the User must carefully assess whether his financial situation and attitude to risk are compatible with such use. The User agrees that Bitcos is not responsible for any losses, damages, expenses, etc., arising as a result of risks from this section and/or due to non-compliance with the recommendations specified here.

3.5. The user can take part in Bitcos promotions at his own risk, such as, for example, creating a blockchain address in the Bitcos crypto wallet with subsequent receipt of any reward. At the same time, Bitcos does not guarantee the provision of remuneration.

3.6. The user understands that the Bitcos Platform is solely an intermediary between him and the corresponding blockchain networks and projects. In this regard, in the case of placing scam tokens (fraudulent) by third parties on the Bitcos Platform and in the case of their acquisition by the User, Bitcos does not bear any responsibility for such actions of third parties, the User and possible damage from this.

4. Acceptable terms of use

4.1. Bitcos grants the User a limited, personal, non-commercial, non-exclusive, non-transferable and revocable license to use the Bitcos Platform. The use of the Bitcos Platform in any other way except as provided in these Rules is prohibited without the prior written permission of Bitcos. The Bitcos Platform may terminate the said license to use the Bitcos Platform at any time in accordance with these Rules.

4.2. Access to the Bitcos Platform may be terminated in cases where the User: provides false, inaccurate or misleading information; undertakes any actions that may create an unreasonable or disproportionately large load on the Bitcos Platform, the Bitcos infrastructure, or the infrastructure of third-party service operators; violates or encourages the violation of the rights and legitimate interests of others; promotes or encourages the promotion and use of any illegal interference in the affairs of third parties, or violates the copyright and other rights of Bitcos; uses the Bitcos Platform for any illegal, aggressive, copyright infringing, defamatory or fraudulent purposes (creating a pyramid scheme or mirroring a website, phishing, etc.); intentionally spreads viruses, worms, Trojan horses, corrupted files, other objects or information of a destructive or misleading nature; prevents the use of the Platform or equipment used by Bitcos to provide its products, by Users, or by others; creates conditions for disabling, blocking, interfering with or bypassing any aspect of Bitcos products (for example, any thresholds or restrictions); creates, distributes, publishes or facilitates unsolicited mass mailing of emails, messages in messengers or other sources of promotions or other offers; uses the Bitcos Platform or any interfaces provided with them to access any other product or service in a manner that violates the terms of service of such other product or service. otherwise violates the provisions of these Rules or the legislation of the Russian Federation or the legislation of the country in which he resides.

4.3. The User agrees not to circumvent, cheat or attempt to circumvent the Bitcos security system, as well as any measures that Bitcos may use to prevent or restrict access to the Bitcos Platform, as well as information systems or networks, etc..

4.4. The User agrees that he will not violate any laws or other regulatory legal acts, traditions or customs when using the Bitcos Platform. We are talking about any local, provincial, state, federal, national or international laws that may be applied to you. The User also agrees that he will not use the Bitcos Platform for payment, financial support or other participation in any illegal activities, including fraud, illegal gambling, money laundering, financing of terrorist activities and proliferation of weapons of mass destruction, etc. The User also agrees not to encourage or encourage any persons to participate in any actions prohibited in accordance with this section and the legislation of the country of residence.

4.5. The User agrees that he will not use or attempt to use the Bitcos Platform under the account (type) of another user without his permission. A similar rule applies to the use of the Bitcos Platform in any way that may interfere, violate, negatively affect or prevent other Users from using the Bitcos Platform without any restrictions. The ban is also imposed on actions that can damage, disable, complicate or degrade the functionality of the Bitcos Platform in any way.

4.6. Bitcos respects the intellectual property of others and therefore we ask Users to do the same. The User agrees that Bitcos owns all copyrights, trademarks, details or any other intellectual property rights in relation to the software, text, video, audio, illustrations, logos, layout, as well as the appearance and image of Bitcos, the Bitcos Platform, the Bitcos Website, with the exception of materials released or provided by Bitcos in accordance with public license agreements, open source. The User may view, print and/or download a copy of the materials that are the property of Bitcos on any PC solely for personal, informational and/or non-commercial use, subject to compliance with all copyright notices and other proprietary rights. Trademarks, service marks, Bitcos logos, as well as other logos used within the Bitcos Platform (hereinafter referred to as "Trademarks") are the property of Bitcos and its owners. Use.

4.7. In certain cases, the User may view, access and use information content, products or services of one or more third parties on the Bitcos Platform (hereinafter referred to as "Third-Party Content"). In all such cases, the User agrees that he/she views, accesses or uses such content and services at his/her discretion. Any interaction with Third-Party Content and the use of third-party services in connection with the Bitcos Platform is governed, on the one hand, by these Rules, and on the other hand, is governed by separate terms and conditions developed by the authors, the provider of this Third-Party Content. These terms and conditions may include separate fees or may include disclaimers or warnings about the risks associated with trust in any information or its accuracy. 4.8. Bitcos disclaims any responsibility and liability for any loss, damage or other consequences for the User related to your dependence on such content or services or their use. Bitcos is not responsible for Third-party Content that may be misleading, incomplete, erroneous, offensive, obscene or otherwise undesirable to the User or in accordance with the laws of the country of his residence. Interaction or correspondence with any third party providing such content or services is carried out exclusively between the User and this third party. Bitcos reserves the right to change, suspend, delete, disable or impose access restrictions or restrictions on the use of any Third-Party Content at any time without prior notice.

5. Guarantees and disclaimer of liability.

5.1 BITCOS WILL APPLY THE NECESSARY LEVEL OF SKILLS AND EFFORTS TO ENSURE USER ACCESS TO THE BITCOS PLATFORM IN ACCORDANCE WITH THESE TERMS OF USE. AT THE SAME TIME, THERE IS NO GUARANTEE THAT ACCESS AND FUNCTIONS WILL BE PROVIDED AT ALL TIMES OR THAT THERE WILL BE NO DELAYS, FAILURES, ERRORS, DISTORTIONS OR LOSSES OF TRANSMITTED INFORMATION IN THE OPERATION OF THE BITCOS PLATFORM. THE SERVICES AND PRODUCTS OF THE BITCOS PLATFORM ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. 5.2 BITCOS SETS AND REGULATES THE COMMISSION (GAS) WITHIN THE BITCOS PLATFORM. THE DECISION TO INTRODUCE A COMMISSION (GAS) BITCOS SETS INDEPENDENTLY AT ANY TIME AT ITS DISCRETION. THE USER USING THE BITCOS PLATFORM AGREES TO CHARGE THIS COMMISSION IN FAVOR OF BITCOS.

THE USER IS AWARE OF AND ACCEPTS THE FACT THAT BITCOS, ITS MANAGEMENT AND EMPLOYEES ARE NOT LIABLE TO THE USER FOR ANY DIRECT, INDIRECT, INCIDENTAL OR POSSIBLE LOSSES, DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFIT, DAMAGE TO REPUTATION, THE POSSIBILITY OF USING DATA, THE COST OF PURCHASING GOODS OR REPLACING GOODS OR SERVICES AND SO ON, AS WELL AS FOR NON-MATERIAL DAMAGE DUE TO:

5.3.3. UNAUTHORIZED ACCESS OR MODIFICATION OF TRANSMISSION DETAILS OR DATA WITHOUT THE USER'S CONSENT;

5.3.4. DELETION, CORRECTION OR MALFUNCTION OF SAVING AND/OR SENDING OR RECEIVING YOUR DATA OR DATA INSIDE OR USING THE BITCOS PLATFORM;

5.3.5. ANY OTHER INTERACTION WITH THE BITCOS PLATFORM. THE ABOVE RESTRICTIONS DO NOT APPLY TO LOSSES RESULTING FROM: FRAUD, INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE ON THE PART OF BITCOS.

6. Compliance with regulatory requirements and restrictions

6.1. Users must comply with all requirements of laws, by-laws, regulations, customs and other fixed norms that apply or arise from their obligations under these Rules, at their own expense.

6.2. When accessing and using the Bitcos Platform, the User confirms and guarantees that he is not included in any trade or economic sanctions lists. Such as: the UN Security Council sanctions list, designated by the OFAC Office (Office of the Office of Foreign Assets Control of the US Treasury Department) as a "List of Prohibited Persons" from the US Department of Commerce, the European Union or its member states, the UK, etc.

6.3. Bitcos reserves the right to choose markets and jurisdictions for its work. In addition, Bitcos may restrict or close access to the Bitcos Platform in certain countries, entities or other territories.

6.4. In case of violation of the rules specified in this Section and (or) other provisions of these Rules, Bitcos reserves the right to terminate the User's service and access to the Bitcos Platform. Bitcos also reserves the right to recover damages, expenses and other monetary payments and (or) perform certain actions in favor of Bitcos in the event of these violations by the User.

7. Termination and suspension of cooperation

7.1. The User has the right to stop using the Bitcos Platform at any time. Bitcos reserves the right to close access to the Bitcos Platform without notice in case of an assumption of a violation of these Rules or for other objective reasons.

7.2. Bitcos does not control access to User wallets and accounts. The user needs to ensure the safety of all his data related to the use of the Bitcos Platform.

8. Applicable law and jurisdiction

8.1. These Rules are based on and regulated by the legislation of the Russian Federation.

8.2. If the User has a claim or request, he has the right to contact Bitcos by e-mail at: denis@bitcos.org

8.3. If the specified claim or request is not resolved on the merits of Bitcos, the User gets the right to submit a request or claim to the court for consideration..

8.4. The user can apply to the court at the location of Bitcos or the person performing management functions in Bitcos.

9. Feedback

Bitcos welcomes feedback, comments, ideas and suggestions to improve the Bitcos Platform, the Bitcos website, etc.
The User can send his suggestions to the following email address: denis@bitcos.org
By submitting their proposals, the User grants Bitcos a non-exclusive, worldwide, perpetual, irrevocable, fully paid, free, sublicensable and transferable license for all intellectual property rights. Bitcos has the right to use them, copy them, modify them at its discretion, delete them, transfer them to third parties and perform other actions.

10. Final provisions

If any provision of these Rules or part thereof becomes invalid or unenforceable to some extent, this does not affect the validity and applicability of other provisions of these Rules.
